SALFORD CITY HOTTEST AWAYDAY (this “Competition”)

TERMS

Promoters: The Manc Creative Limited of Suite 32, Barton Arcade, Manchester, Greater Manchester, M3 2BH (company no. 11813317) (“The Manc“) and Sazerac UK Limited under its Fireball Liqueur with Cinnamon & Whisky brand of 60 Marina Place, Hampton Wick, Kingston Upon Thames, KT1 4BH (company no. 04682459) (“Fireball” and together with The Manc, the “Promoters“, “we“, “our“, “us“).

These Terms (these “Terms“) are available online at www.TheManc.com (the “Website“) and they set out our relationship with you, the entrant (“you”, “your(s)”, “Entrant(s)“) in relation to this Competition.

By entering this Competition, you confirm that you have legal capacity to enter this Competition and you agree to be bound by these Terms (which may be amended or varied at any time by us and all such changes will be posted in revised Terms on the Website) and by our decisions, which are final in all matters relating to these Terms, this Competition and the winners’ selection. No correspondence or discussion shall be entered into.

All information provided by you in connection with this Competition is provided to us directly and not to Meta or Instagram. This Competition is in no way sponsored, endorsed or administrated by, or associated with Meta, or Instagram and Meta, or Instagram shall have no responsibility or liability to you in respect of this Competition and you agree to release Meta and Instagram against any such claims.

1. Eligibility:

1. (a)  You must be twenty-five (25) years old or over, have a valid and active Instagram account and email address and not be prohibited from attending football matches within the UK (including at Rodney Parade).
2. (b)  You are not eligible to enter if you are: (a) an employee of the Promoters, their group companies, prize suppliers, marketing agencies, contractors and advisors; (b) an immediate family member of such employees (mother, father, brothers, sisters, sons, daughters, partner or spouse) or domiciled with such employees; and/or (c) the independent adjudicator.

2. Announcement: The Manc will publish an announcement post between 13:15-13:30 British Summertime (BST) on 28 September 2024 announcing the start of the Competition (“Announcement“). This Announcement and earlier promotional posts will be promoted on the Instagram accounts of The Manc (@the.manc), Fireball (@fireballuk) and Salford City FC (@salfordcityfc). Therefore, to see the posts, we suggest that you follow at least one of these accounts.
3. Entry Period: This Competition starts at the time of the Announcement (see rule 2 above) and closes at 12.00 (midday) BST on Monday 30 September 2024 (“Entry Period“).
4. How to Enter:

(a)

To enter this Competition, you must do the following during the Entry Period:

i. follow the Fireball UK Instagram account at @fireballuk (if you do not already follow the account);

2. like the Announcement; and,
3. tag a friend (who must also be aged 25 years +) that you would like as your

guest if you are selected as a winner (“Guest“) in the comments section of the Announcement, (“Entr(y)(ies)“). Limit one (1) Entry per person. Entries must be received during the Entry Period.

2. (b)  BysubmittingyourEntrytotheCompetition,youagreethatwecanrespondtoyourEntryand communicate with you via direct message (using the direct message functionality) on Instagram in connection with the administration of this Competition.
3. (c)  By submitting your Entry to the Competition, you agree that your Entry does not include any other text, images or information, except your tagged friend.
4. (d)  By entering the Competition and submitting an Entry you agree that such Entry, with the exception of personally identifiable information as identified in the Promoters’ respective privacy policies available at https://sazerac.co.uk/privacy-policy/ and https://themanc.com/privacy-policy/?ampis deemed to be non-confidential and non-proprietary, and the Promoters shall have no obligation of any kind with respect to such Entry.
5. (e)  Any use by Entrants of identities other than their own and any attempt by an Entrant to obtain more than one (1) Entry by using multiple/different Instagram accounts and/or email addresses, and/or any other methods, will void all of that Entrant’s Entries and that Entrant may be disqualified from this Competition. The winners may be required to show proof of being the authorised account holder.

5. Winners:

1. (a)  There will be a total of two (2) first prize winners. The prize draw will take place at Fireball’s offices at approximately 12:00 BST on Monday 30 September 2024. Two (2) winners will be selected at random from all valid and eligible Entries received during the Entry Period in accordance with these Terms and Conditions.
2. (b)  In order to be declared a winner you and your Guest will each be required to sign a release and waiver form and present valid personal identification documents to prove your identity and age. We will endeavour to notify the winners via the direct message functionality on Instagram (please ensure that your account is not private) by 15:00 BST on Monday 30 September 2024, providing you with a copy of the release and waiver form and requesting certain information from you to verify your eligibility, including your age and weight and the weight and age of your Guest. It is your responsibility to obtain the relevant information from your Guest. We may also request your telephone number, in order to obtain this information and discuss the prize. You must confirm your acceptance of the prize and provide the requested information and copies of ID to the Fireball representative (by DM or email to [email protected]) by no later than 17:00 BST on Monday 30 September 2024. Otherwise, your prize will be forfeited.
3. (c)  Once the verification process has been completed, the Fireball Representative will send you confirmation that you are a winner by DM on Instagram and also give you the details of a pick-up location in Salford (“Pick-up Location“). You must make your own way to this Pick-up Location by 15:00 on Tuesday 1 October 2024.
4. (d)  You and your Guest must each bring a valid personal ID with you to the Pick-up Location (such as a current driving licence or passport). You will also be responsible for paying any personal tax obligations that may arise in connection with the prize.

6. Prizes:

(a) Each of the two (2) winners will receive the following:

• ·  two (2) standard seat tickets to the League Two football fixture between Newport County FC v Salford City FC at 19:45pm on Tuesday 1 October 2024 (the “Match“);
• ·  two (2) seats on a helicopter round trip flight between Salford and Newport. The outbound flight will aim to depart Barton Aerodrome between 16:30-16:45 on 1 October 2024 and the return flight will aim to depart Newport between 22:15-22:30 on the same day after the Match. Both winners and their Guests will board the same outbound and return flights (“Flights“). Winners and Guests must be promptly available for the Flights. The Flights will not be delayed if they fail to turn up on time and the prize (or specific element) will be forfeited as a result;
• ·  ground transfers: (a) from the Pick-up Location to the Manchester Barton Aerodrome; (b) between the Newport take off/landing location and Newport County FC’s ground, Rodney Parade; and (c) the Manchester Barton Aerodrome to your home address (provided that it is within a Manchester post code). We may also film, interview and photograph you and your Guest and record your and your Guest’s voice in and around the Pick-up Location, the helicopter take-off and landing locations in Manchester and Newport, on the Flights, Rodney Parade, and at the Match for the purposes of using such content for internal and external marketing purposes to promote our products and brands. See rule 9(c). Each winner and their Guests will also be required to sign a consent and waiver form by us (see rule 5(b)).

2. (b)  By accepting a prize, you and your Guest each confirm that you are fit to fly; that you do not have any health and/or medical condition or reason that prohibits you from flying and you have not been advised a health professional not to fly; you are not more than twenty-seven (27) weeks pregnant; and you do not weigh more than ninety (90) kilograms. Winners and their guests may be required to sign certain pre-board documentation for the Promoters and/or the supplier of Flights, which may include a release and waiver form (“Supplier Documentation“). The supplier (including the pilot) reserves the right to refuse to board any individual for any reason whatsoever, including without limitation, if they believe that the individual is not fit to fly and any of the other restrictions detailed above; if they are unable to board a passenger due to excess weight of the individual and/or special accessibility requirements (which are not compatible with the aircraft; which could delay the flight departure time and/or exceed the total aircraft flight allowance and/or requires the carriage of wheelchair batteries that are prohibited on the aircraft; if they believe that the mental or physical condition of the individual, including impairment by alcohol or drugs, presents a hazard or risk to himself, to passengers, to crew or to the helicopter. If a first prize winner cannot be boarded onto the aircraft due to accessibility requirements, then they will be awarded the replacement prize at 6(g) below. If you are unable to board the flight/aircraft for any other reason, the prize will be forfeited.
3. (c)  Winners and their Guests must be eligible and available to board the Flights and attend the Match or the prize will be forfeited.
4. (d)  Allprizesaresubjecttothetermsandconditionsofthevenueorrelevantsupplier.
5. (e)  Prizes may only be redeemed by the individual winner and will only be awarded on verification by us that the winner has complied with these Terms.
6. (f)  All other expenses, including without limitation, ground transfer to the Pick-up Location, meals and beverages, gratuities, spending money, and other expenses not expressly specified herein are the sole responsibility of the winners.
7. (g)  If due to adverse weather conditions and/or other circumstances beyond our control we are unable to provide the stated prize(s), we reserve the right to award a substitute prize, comprising of the following: each of the two (2) winners will receive tickets to a Salford City FC home game during the 2024/2025 season in a hospitality box including food and beverages (to be selected and provided at our sole discretion) with the opportunity to bring along their Guest and up to eight (8) other guests.

Date will be subject to availability and must be booked at least two (2) months in advance unless exception is expressly granted. Winners will need to liaise with the Fireball Liqueur with Cinnamon & Whisky representative via email at [email protected] to check date availability, confirm the booking and make all arrangements for the prize. Failure to do so will result in the prize being forfeited. The winners and their guests must all be aged twenty-five (25) and over and present personal identification documents to prove their identity and age. You will also be responsible for paying any personal tax obligations in connection with the prize. All other expenses, including without limitation, ground transportation to and from Salford City FC’s Peninsula ground, meals and beverages, gratuities, spending money, and other expenses not expressly specified herein are the sole responsibility of the winners and their guests. All other relevant prize and winner terms in these Terms apply.

7. Disqualification:

1. (a)  Invalid and ineligible Entries will be disqualified.
2. (b)  WealsoreservetherightinoursoleandreasonablediscretiontodisqualifyanyEntrantwho:

i. cannot be contacted after two (2) attempts by 15:00 BST on Monday 30 September 2024; and/or

ii. a winner does not confirm their acceptance of their prize and provide the requested information in accordance with the timelines in rule 5(b); and/or

3. we have reason to believe has breached any of these Terms; and/or
4. does not comply with Instagram’s terms, conditions and policies; and/or
5. refuses to sign the consent and waiver form (as per Rules 6(a) and (b)); and/or
6. refuses to sign the Supplier Documentation; and/or
7. is unable to accept the prize; and/or
8. corrupts or affects the administration, security, fairness, integrity or proper conduct

of this Competition; and/or

ix. is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of this Competition; and/or

x. is intoxicated or showing signs of intoxication. Any drinking must be carried out responsibly; and/or

xi. is found to be making hateful football speech. Hateful football speech and any other form of aggression and discrimination will not be tolerated.

(c) In the case of disqualification, the winner forfeits the prize and we reserve the right to award the prize to an alternative winner from all remaining valid and eligible Entries at random using the process detailed in rule 5(a).

8. Liability:

1. (a)  We accept no responsibility for any illegible or incomplete Entries or any incorrect or inaccurate information or lost or late Entries; any damage, loss, liabilities, injury or disappointment incurred or suffered by the winner due to entering this Competition and/or accepting the prize; and/or any error, omission, interruption, delay, technical or transmission failures, virus, bugs or other causes beyond our control, which affect the administration of this Competition.
2. (b)  Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation.

1. (a)  The Promoters will use the personal data that they collects in connection with this Competition as set out in their respective privacy notices: https://sazerac.co.uk/privacy-policy/ and https://themanc.com/privacy-policy/?amp . We will use your personal information for the purposes of your entry into this Competition, to conduct and administer this Competition and to inform Entrants, upon request, of the winners’ details (in accordance with rule 10) and fulfilling prizes.
2. (b)  Ifwedonotcollectyourpersonalinformation,youwillnotbeabletosubmitavalidEntryinto this Competition or claim your prize. We may disclose this personal information to third parties for the sole purpose of processing and conducting this Competition.
3. (c)  If you are declared a winner, you agree to allow us to: (a) film, interview and photograph you and record your voice in and around the Pick-up Location, the helicopter take-off and landing locations in Manchester and Newport, on the helicopter flights, Rodney Parade, and at the Match (“Your Contribution“) and use Your Contribution, your name, address, and or photograph or other likeness, as well as your appearance at publicity events without any additional compensation and as required by the Promoter to promote you as a winner of this Competition and for all internal and external marketing purposes to promote our products and brands worldwide in any media now known or hereinafter invented. For the avoidance of doubt, we shall not be obliged to use, distribute or publish such content in any form an any use of such content shall be at our sole discretion; we shall have sole editorial control over any uses of such content; and you shall have no approval rights.

Winners’ List: The name of the winners and their home city will be available for thirty (30) days after the end of the Entry Period by sending an email to [email protected].

Governing Law: These Terms shall be governed by and construed in accordance with English law and any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the English Courts.
